As with gifts, an Attorney cannot use your money for the Attorney’s benefit, or the benefit of any other person, unless the power of attorney form specifically allows the Attorney to do so.
This means if you wish to allow the Attorney to use your money for housing, food, education, transportation and medical care of the Attorney or a person nominated in the power of attorney (for example, your children) you must expressly state so. As with gifts, the amount of the benefit must be reasonable having regard to your financial circumstances and the size of your estate.
