Exiting Legacy pensions and reserves in an SMSF

Following the release of Regulations in December 2024 allowing for certain legacy pensions to be commuted within a 5 year window and to make for easier allocations from reserves held within an SMSF, it’s important to know what opportunities these regulations actually provide for.

In this webinar, Tim Miller from Smarter SMSF, who was part of the SMSF Associations consultative group with Treasury on these regulations, will take an in depth look at what is required to commute a pension, how and why an SMSF may have reserves, how different reserves can result in different outcomes and what order any allocations should be made.

Further, Tim will highlight all the administrative and compliance considerations that accompany the decision to commute a pension as will contemplate the Social Security issues that many clients will have.

Learning Outcomes

At the end of this webinar, participants will have an appreciation for:

  • Which pensions can be commuted under these regulations and what the requirements are to commute each pension
  • Which reserve allocations are not measured against any caps
  • Which reserve allocations will be measured against the non-concessional contribution cap
  • How the death of a pensioner can impact the decisions made
