SMSF trustees have a minimum annual requirement to review the fund’s investment strategy and whilst no such regulatory requirement exists for reviewing the fund’s succession plan, it is just as critical.  Having an appreciation for what the SMSF trustee structure might look like when a member passes away is just as important and having clear and concise instructions from the members as to how they want their benefits to be paid.

A number of recent Court cases have highlighted that dealing with related parties can be both convenient and yet complex at the same time, as Fund Auditors and indeed the Regulator look beyond the transaction itself to determine whether its purpose and application satisfy the various superannuation investment restrictions.  At their very core, SMSF related party transactions will need to pass more than one regulatory provision and often that number is 3 or more once you factor taxation.
